1) Acknowledgment of Risk
By accessing, participating in, or engaging with any programming, content, events, promotions, or communications provided by The Big 816 (the “Services”), I acknowledge and understand that:
The Services are provided for informational and entertainment purposes only.
Content may include third-party materials, live programming, and user-generated content thatThe Big 816 does not control.
Technical issues (including interruptions, outages, data loss, or unauthorized access) may occur despite reasonable efforts to maintain the Services.
Any links or references to third-party websites, products, or services are provided for convenience and do not constitute endorsements by Big 816.
 
2) Assumption of Responsibility
I agree that I am solely responsible for:
How I use, interpret, or rely on any information or content from the Services;
Ensuring my equipment, internet connection, and software are adequate and secure;
Compliance with all applicable laws, including intellectual property and communications regulations;
Evaluating and taking appropriate precautions when interacting with third-party links, content, or services referenced by Big 816.
 
3) Release of Liability
To the fullest extent permitted by law, I hereby release, waive, and dischargeThe Big 816, its owner, officers, contractors, vendors, and affiliates from any and all claims, demands, liabilities, damages, losses, costs, and expenses (including attorneys’ fees) arising out of or related to:
My access to or use of the Services;
Any reliance on information, opinions, or content provided;
Any event, promotion, or interaction facilitated by The Big 816, whether online or in-person;
Interruptions, errors, data breaches, malware, or other technical issues.
 
This release includes claims based on ordinary negligence but does not waive liability to the extent prohibited by law (e.g., willful misconduct or gross negligence where such waiver is not permitted).
 
4) No Warranties
The Services are provided “as is” and “as available.” The Big 816 disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
 
5) Limitation of Liability
To the maximum extent allowed by law, The Big 816 will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or business interruption, even if advised of the possibility of such damages. Big 816’s total cumulative liability for any claim related to the Services will not exceed the amount, if any, paid by me to The Big 816 for the specific Service giving rise to the claim in the twelve (12) months preceding the claim.
 
6) Indemnification
I agree to indemnify, defend, and hold harmless The Big 816 and its owner from any claims, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising out of my use of the Services, violation of this agreement, or infringement of any third-party rights.
 
7) Intellectual Property
All content provided by The Big 816 is owned by or licensed toThe Big 816 and protected by law. I will not reproduce, distribute, or exploit the content except as expressly permitted.
 
8) Severability and Governing Law
If any provision of this agreement is found unenforceable, the remaining provisions will remain in effect. This agreement is governed by the laws of the State of Missouri, without regard to conflict-of-law principles, and any disputes will be brought exclusively in state or federal courts located in Missouri.
 
9) Acknowledgment and Consent
I have read and understand this Liability Waiver and Release Agreement. I acknowledge that I am voluntarily agreeing to its terms and that I have the right to seek independent legal advice. By signing below (or by affirmatively accepting electronically), I agree to be bound by this agreement.

2) Rights Confirmation
By submitting, I represent and warrant that:
I am the owner or have full authority from all rights holders (writers, performers, producers, labels) to grant this license.
The track and artwork do not infringe any third-party rights, and all samples are cleared.
I am at least 18 years old (or have guardian consent below).
 
3) Grant of License
I grantThe Big 816 a non-exclusive, worldwide, royalty-free license to:
Broadcast, stream, and rebroadcast the track on The Big 816’s channels, programs, and archives;
Use my name, likeness, artwork, and track metadata for programming, schedules, show archives, and promotional purposes (including social media and website);
Edit for technical purposes only (e.g., volume normalization, radio edits for profanity as required by policy/law) without altering the musical essence.
 
This license is revocable by me with 30 days’ written notice; revocation does not require removal from past broadcasts, archives, or existing promotional materials.
 
4) No Obligation; Submission Policy
The Big 816 is not obligated to air any submission and may refuse or remove content at its discretion.
Airplay timing, frequency, and placement are atThe Big 816’s editorial discretion.
Submissions must comply with applicable laws and The Big 816 policies.
 
5) Compensation
No payment is due for submission or airplay.
I retain all ownership of my master and composition rights.
Any statutory or PRO royalties arising from broadcasts/streams will be handled through applicable collection societies.
 
6) Indemnity and Release
I release and hold harmless TheBig 816, its owner, staff, and affiliates from claims arising from the broadcast, promotion, or use of the submitted materials as permitted here. I agree to indemnify The Big 816 for any claims due to my breach of the above warranties (including uncleared samples or unauthorized submissions).
 
7) Data & Contact Permission
I consent toThe Big 816 storing my submission details and contacting me about programming, promotion, or related opportunities. I can request deletion of my personal data subject to legal/operational needs.
 
8) Term, Governing Law, and Disputes
Term: Effective upon submission; continues unless revoked per Section 3.
Governing Law: State of Missouri, without regard to conflict-of-law rules.
Venue: Courts located in Missouri.
Severability: If any clause is unenforceable, the remainder stays in effect.
 
9) Parental/Guardian Consent (if under 18)
I am the parent/legal guardian and consent to the above on behalf of the minor.
